Welcome to Off Centered Swag! Throughout the site, the terms “we”, “us” and “our” refer to Off Centered Swag, LLC. We offer this website—including all the information, tools, and stylishly off-beat apparel—to you, the user, conditioned upon your acceptance of everything written here.

By visiting our site or buying something from us, you’re engaging in our “Service” and agreeing to be bound by the following terms and conditions (“Terms of Service”, “Terms”). If you don’t agree to all the terms and conditions of this agreement, then you probably shouldn't hang out here, and you definitely can't buy our swag.

SECTION 1 - THE BASICS

By agreeing to these Terms, you’re telling us you’re at least the age of majority in your state or province. If you’re letting your minor dependents use this site, you’re taking responsibility for their shopping habits. You can’t use our products for anything illegal or unauthorized. Also, don’t transmit any worms, viruses, or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services (and a very disappointed look from our team).

SECTION 2 - THE GOODS (ACCURACY & COLOR)

We do our best to show you exactly what our swag looks like. However, your computer monitor or phone screen might have its own "off-centered" personality. We cannot guarantee that your screen’s display of any color will be 100% accurate to the physical product. All our items are made-to-order. We reserve the right to limit the sales of our products to any person or geographic region, and we can change product descriptions or prices at any time without telling you first.

SECTION 3 - ORDERS & CANCELLATIONS

When you click "Buy," you're making an offer. We reserve the right to refuse any order you place with us. Because we use a Print-on-Demand model, our production usually starts shortly after you order. This means we may be unable to accommodate cancellation requests once the "ink starts hitting the fabric." Please double-check your cart!

SECTION 4 - BILLING & ACCOUNT INFO

You agree to provide current, complete, and accurate purchase and account information. If your credit card expires or you move to a new secret lair, please update your Shopify account so we can get your swag to the right place. You represent that you are authorized to use whatever payment method you provide.

SECTION 5 - SHIPPING: THE HANDOFF

Once we hand your order over to the carrier (USPS, UPS, etc.), the "risk of loss" passes to you. We aren't responsible for the carrier’s delays or if a porch pirate decides they like your taste in apparel. We provide estimates, not guarantees.

SECTION 6 - INTELLECTUAL PROPERTY (OUR STUFF)

This is the big one. All content on this site—including designs, logos, text, and graphics—is the property of Off Centered Swag, LLC or our artist partners.

• Don't steal our vibe: You may not reproduce, duplicate, copy, sell, or exploit any portion of our designs or Service without express written permission from us.

• Artist Rights: Many of our designs are licensed from independent artists. Stealing a design doesn't just hurt us; it hurts the creators. We defend our IP aggressively.

SECTION 7 - THIRD-PARTY TOOLS & LINKS

We might give you access to third-party tools (like order trackers). We provide these “as is” and have no liability for what happens when you use them. Similarly, if you click a link that takes you away from our store, we aren't responsible for what you find on the other side of the internet.

SECTION 8 - FEEDBACK & SUBMISSIONS

If you send us a brilliant idea for a shirt, a review, or a suggestion (“Feedback”), you’re giving us a perpetual, royalty-free license to use it. We aren't obligated to pay you for it or keep it secret. If your feedback is offensive or illegal, we’ll delete it.

SECTION 10 - PROHIBITED USES

In addition to other prohibitions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; or (e) to upload or transmit viruses.

SECTION 11 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We don’t guarantee that our service will be uninterrupted or error-free. You agree that your use of the service is at your sole risk. TO THE MAXIMUM EXTENT PERMITTED BY LAW, Off Centered Swag shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind—including lost profits or lost savings—arising from your use of any of the service or any products procured using the service.

SECTION 12 - INDEMNIFICATION

If you do something that gets us sued (like violating a law or a third-party's rights), you agree to indemnify, defend, and hold harmless Off Centered Swag, LLC and our partners from any claim or demand, including reasonable attorneys’ fees.

SECTION 13 - SEVERABILITY & TERMINATION

If any part of these Terms is found to be illegal or unenforceable, the rest of the Terms still stand. We can terminate this agreement at any time if we think you’ve broken the rules.

SECTION 14 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Michigan, USA. Any disputes arising from these terms will be handled in the courts of Washtenaw County, Michigan.
